Inclusive Education for all under the ambit of Right to Education


Following a plea filed by the Vidhi Center for Legal Policy seeking to ensure that the Right to Education for children with disabilities was enforced across the country, a bench consisting of Acting Chief Justice Gita Mittal and Justice C Hari Shankar have issued a notice to the Center and Ministry of Social Justice and Empowerment.

Under the United Nations Convention on Rights of Persons with Disabilities, India is under an obligation to make education inclusive and ensure that students with or without disabilities can learn together. Under the current Right to Education (RTE), there is no obligation for schools to provide facilities conducive to the needs of students with disabilities. The petition aims to correct this by bringing the norms of inclusive education under the ambit of RTE.
